General Terms and Conditions of Business of Happy Young Learning

§1 Liability towards companies and definitions

(1) The following General Terms and Definitions of Business apply to all supplies between our company and a consumer in the version valid at the time of placing the order.

 

(2) "User“ within the meaning of these General Terms and Conditions refers to natural persons who enter into a legal transaction for purposes not covered by their commercial or self-employed professional activity.

 

§2 Conclusion of a contract, electronic storage of the contract

(1) The following provisions regarding the conclusion of contract apply to purchase orders made through our online shop happy-young-learning.com .

(3) The presentation of the goods in our online shop do not constitute a legally binding offer on our part and is only a nonbinding invitation to the User to order the goods. On ordering the requested goods, the User submits a binding request to conclude a purchase contract on his part.

The request is accepted in writing or in written form or by shipping the ordered goods within one week. Should this period of time expire without satisfactory result, the request is regarded as refused.

(4) In receipt of a purchase order in our online shop, the following rules shall apply: The User sends a binding contract request by successfully carrying out the ordering procedure provided in our online shop.

The ordering process comprises the following steps:

1) Selected the required goods
2) Confirm by clicking the button "Add to cart“
3) Check the information in the shopping cart
4) Confirm by pressing the button "View cart“
5) Log in to the online shop by registering and entering your user details (email address and password).
6) Check or correct the data you entered again. 
7) Send your order (binding).

Before sending a binding order, the User can return to the web page containing the customer's details to check the inputs by pressing the "Back" button in the Internet Browser and correcting any input errors or cancel the ordering procedure by closing the Internet Browser. We will confirm receipt of the order immediately by sending an automatically generated email (confirmation of receipt). This does not represent any acceptance of the request. Acceptance of the request will be in writing, in written form or by shipping the ordered goods within one week.

(5) Electronic storage of the contract text or orders in our online shop: We will store the contract text and send you the ordering data and our General Terms and Conditions by email. 

§3 Prices, shipping costs, payment, settlement

(1) The quoted prices include the statutory VAT and other price components. Any shipping costs are extra.

(2) The User can pay in advance or on receipt of invoice.

(3) If the User chooses to settle by prepayment, he or she is obliged to pay the purchase price immediately on conclusion of contract.

§4 Shipment

(1) Unless otherwise stated in the product description, all items on offer are ready for shipment.

(2) If the User chooses to settle by prepayment, we shall not ship the goods until we have received payment.

§5 Reservation of title

We retain the right of title to the goods up until full payment of the purchase price.

§6 Right of withdrawal

Right of withdrawal

You are entitled to withdraw from your contract in written form (e.g. letter, fax, email) within 14 days without stating any reason or by returning the goods back within the stated period of 14 days. The period starts on receipt of this notification in writing but not before receipt of the goods by the Receiver (where similar goods are delivered on a recurring basis, then not before receipt of the first part delivery) nor before we have fulfilled out obligations to provide information as defined in Article 246 § 2 in

connection with § 1 sentences 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) and our obligations under § 312g sentence 1 clause 1 German Civil Code (BGB) in conjunction with Article 246 § 3 EGBGB. Your right is ensured if your written withdrawal and/or return of the goods takes place within the time limit.

Consequences of withdrawal

If you exercise the above right to withdrawal, you are required to return the relevant goods or services and possibly the monetary benefits derived from them (e.g. interest). In case you are unable to reimburse or return to us the goods received or the derived profits (e.g. use advantages) in part or in total or only in poor condition, you shall have to pay compensation for the value accordingly. You are under obligation to replace the value in case of a deterioration or compensate for use only insofar as the use or deterioration is caused by handling the goods over and beyond checking the properties and operation of the goods. By "checking the properties and operation of the goods" it is means that testing and trying the individual items in the same manner as would be possible and usual in a shop for example.
Goods suitable for shipment by parcel post shall be returned to us at our risk. You must bear the regular costs of return shipment if the delivered goods correspond to the purchase order and if the purchase price of the returned goods does not exceed an amount of 40,00 euros or if, in the case of a higher purchase price, you have not yet undertaken to pay the purchase price or an agreed instalment at the time of withdrawal. Otherwise return delivery is free of charge for you. Goods not capable of being shipped will be picked up from your postal address. You are obliged to refund any open payments within 30 days. The period begins with the transmission of your statement of withdrawal or on receipt of the goods which you returned to us.

§7 Contractual provision regarding the cost of returns in case of withdrawal

If you exercise your right of withdrawal, the following agreement shall apply pursuant to § 357 sentence 2 BGB (German Civil Code) according to which you must bear the regular costs of return shipment if the delivered goods correspond to the purchase order and if the price of the goods to be returned does not exceed an amount of 40,00 euros or, in case of a higher purchase price, you have not yet undertaken to pay the purchase price or an agreed instalment at the time of withdrawal.

Otherwise, the return shipment is free of charge for you.

§8 Language of the agreement

The contract language is all cases shall be German.

Consequences of cancellation

If you exercise the above right to cancellation, you are required to return the relevant goods or services and possibly the monetary benefits derived from them (e.g. interest). In case you are unable to return to use the goods received in part or only in poor condition, you shall have to pay compensation for the value accordingly. In the case of goods provided for use, this does not apply if the deterioration of the goods is exclusively due to their being inspected, as may occur in a shop. For the rest, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect their value. Goods suitable for shipment by parcel post shall be returned to us at our risk.

The Seller shall always bear the costs of shipment and basically the costs of return. However, in case of a previous contractual agreement, you must bear the regular costs of return shipment if the delivered goods correspond to the purchase order and if the purchase price of the returned goods does not exceed an amount of 40,00 euros or if, in the case of a higher purchase price, you have not yet undertaken to pay the purchase price or an agreed instalment at the time of withdrawal. Goods not capable of being shipped will be picked up from your postal address. You are obliged to refund any open payments within 30 days. The period begins for you when you send the declaration of withdrawal or we receive the goods you returned to us.
